Areas of Practice - Insurance Law

The attorneys in our insurance law practice are problem solvers. Each claim is promptly and carefully analyzed. We work closely with our clients to provide a road map that leads to a successful conclusion of each and every claim.

The attorneys in our insurance law practice have a wide breadth of experience with complex insurance issues. We work as partners with both domestic and international insurers to resolve all manners of first-party and third-party claims. Our philosophy is simple and straightforward - assist our clients in paying claims that are owed and resisting claims that are inflated or not owed at all.

Our insurance lawyers investigate, provide advice, and litigate claims involving all types of policies including windstorm, homeowners, commercial, cargo and specie, and professional liability. We routinely handle issues involving fraud, bad faith “set ups”, intentional conduct, misrepresentations in applications, valued policy law considerations, appraisals and other complex coverage issues. We also prosecute subrogation actions, obtaining recoveries and minimizing the exposure to our clients. Our lawyers also have experience litigating errors and omissions (E&O) claims asserted against insurance agents and brokers.

The laws and regulations governing claims are evolving constantly. Our experience advising national and international insurers positions us to analyze and advise our clients as to the complex issues facing insurers in Florida.

The potential for extra-contractual exposure is an ever-present threat, should a claim be handled improperly. We regularly assist insurers in handling claims from their inception through successful conclusion. This may entail supervising fire scene investigations, conducting examinations under oath, providing coverage opinions, drafting reservations of rights or denial letters, and litigating throughout the state of Florida

Proper claims preparation offers the best opportunity to avoid bad faith and the cost and expense of litigation. Our firm advises claims departments on how to modify and improve their claims procedures. We work with claims staff to explain how claims files are used in court and demonstrate the best practices to avoid litigation in the first place as well as the pitfalls that could lead to potential “bad faith” exposure.
